The FDA says it is aware that flavored e-liquids are favored by young adults, but that young adults should also be protected contrary to the over-selling of the products by adult consumers. Based on the FDA’s warning letters, a number of the e-liquids in question had no flavor; however, these were being offered for sale in candy bars disguised as a healthy snack.
Cool Cloud Vapor had marketed its e-liquid product as a supplement and a sports drink. These statements were misleading, the FDA claims, because no FDA regulatory expectations or laws exist to modify health supplements and sports drinks. The company’s application for a non-prescription marketplace distribution label specifically stated that the product could possibly be used as a supplement.
